Hi. Long time to see. Not sure if this is the right place to post, if not please move it elsewhere.

I was wondering if I am legally allowed to use RuneScape Wiki's images in YouTube videos. Youtube is picky about making sure all content in videos is okay to use. I would be making a small amount of money. I'm not sure if images uploaded to RSW are public domain, or they belong to Wiki or what. Can anyone link me to copyright rules for images uploaded? For example, I would be using the picture of the mith dragon on Mithril dragon in a mithril dragon killing guide.

I am not totally sure, so don't take my word for this. There are a few things at play. Whether we as a community allow this, which I'd most definitely think we do. We do upload our images without ownership, so anyone can use them freely I believe. But then there is Wikia's stance. We know they don't run this place like Wikipedia, so maybe they assume ownership of the content. Read their licensing stuff here. On top of this is Jagex's perspective. We are able to take in-game images and upload them here, but what worries me is when you say you'll use it to make money (I don't know how you're gonna make money through YouTube! :P ). I guess Wikia makes money off of Jagex's content on our wiki through their advertising, so it must be okay. I assume it should be okay to use. By the way, if you want to make helpful guides/videos about RuneScape, you could make them for our semi-official YT channel that I am yet to launch. :P Cheers, Chicken7 >talk 03:04, October 15, 2011 (UTC)

We require content to be attributed; however, images are not content. While we very much hope you'll attribute the pictures, there is no way for us to force you to do so because Jagex owns the models and our pictures are simply a derivative work. Jagex obviously has no problem with using pictures of their game in videos, and from a copyright point of view, you using our images is no different than taking images of your own.

As for you using Jagex's content on a for-profit video, that would rest on whether or not you could claim fair use. The long answer is that it probably doesn't fall under fair use, but the short answer is that no one really cares about it. ʞooɔ 03:13, October 15, 2011 (UTC)

Comment - Firstly, the disclaimer: I am not a lawyer and don't know more than my nerdiness has taught me, so give no guarantees on the validity of anything I say. So, all CONTENT of the wiki is CC-BY-SA, but images are not necessarily so. For example, the majority of our images are copyrighted to Jagex, and we use them under the fair use clause. Judging from the number of existing youtube videos, many which will be obtaining (paltry) profit, Jagex doesn't care. In fact, it's free advertising for them, so they encourage it (as seen by the Golden Gnomes, etc). Hofmic Talk 03:23, October 15, 2011 (UTC)

Comment, all of our RuneScape images are non-free images that we use under fair use laws - if you want to use them, that depends entirely upon Jagex and their permission to make money off of the images. If they are OK with it, then there isn't an issue. ajr 03:48, October 15, 2011 (UTC)

RuneScape might have an issue with you using them (and us, in fact, since Wikia makes bukkitloads off of this site). From their ToU: "You may not use these [images] except in accordance with these terms and conditions and for personal (i.e. non-commercial) use only." ajr 03:54, October 15, 2011 (UTC)

The Answer - Yes. You can use them without attribution if you want, but it'd still be decent of you to attribute them. The content of the images are owned by Jagex, not us. As such they are not applicable for CC-by-SA licensing. I know this because I actually talked to a representative of the Machinima channel about a video uploaded on their channel which contained unattributed images taken from the wiki. In looking into the matter of licensing issues, they determined that because the content of the images is something that Jagex created, and therefore owns, we cannot claim ownership of the images at all. You may doubt that Machinima is qualified to speak on manners of copyright, but they are. Joi Ito, the CEO of Creative Commons is on the board of Machinima inc. Comment - While you can use them, as Psycho said, we'd appreciate if you'd put the source in the video, be it directly under the image or in the credits or something. Erm... - Jagex hosted A COMPETITION FOR RUNESCAPE VIDEOS ON YOUTUBE... Just saying...
